Slingshot Assault Case: Correction

February 22, 2012

A correction to a story we aired Tuesday about the local youth who won a civil case regarding a traumatic incident on the highway outside Nelson eight years ago.

We reported a story from The Province newspaper that ran a headline suggesting Dylan Plishka-Humphreys - then 13 years old- was responsible for firing a ball-bearing that smashed a window of a passing truck. The driver Daniel Bolen stopped and assaulted Plishka-Humphreys.

Court documents show he did not fire the slingshot and it was in fact another youth who was with him at the time. Plishka-Humphreys was attempting to apologize to Bolen when he was assaulted.

Damages relating to the assault and battery will be determined at a later date.

After the criminal case in 2005 Bolen was sentenced to 90 days in jail.
